  • Copyright, Designs and Patents Act 1988 - exists to protect peoples' creations such as a picture, drawing or photograph, a video, television programme or film, text, such as a book, article or report, a game. Copyright gives the copyright holder exclusive rights to publish, copy, distribute and sell their creation. No one else can use the work without permission.
Why is it important? it keeps peoples creative property safe, it keeps people from profiting off  others work, It makes sure the creator of the product is rightly credited and paid for there work.

What are the consequences of not adhering to this law? you can get a copy write strike meaning your product will be taken down.

How does this law effect pre-production of a media product? if you do not have permission from the owner for example to use a song for your movie you will not be able to use that song and you would have to pick another.

  • Freedom of information Act 2000 - An Act to make provision for the disclosure of information held by public authorities or by persons providing services for them. The Freedom of Information (FOI) Act 2000 was introduced to give the public the right to access any information recorded by public sector organisations. These organisations include: schools, councils government departments, health trusts and hospitals, libraries, museums. Anyone is able to request information, regardless of how old they are, where they live or their nationality.

  • Intellectual Property Rights - it protects:

    the names of your products or brand

    the design or look of your product

    things you write, make or produce

    consequences if the law isn't followed;

     

    Criminal fines

    Imprisonment (the length of time depends on the nature of the charges)

    Seizure of the stolen intellectual property (ECT)

    how does it effect preproduction of a media product?

     

    it protects creators or owners of rights by preventing others from using their work, this also means that if the production involves commissioned work ( for example) you must have permission from the creator of that piece of work to feature it in your media product.

    How does it effect the production of a media product?

     

    it would require the producers to gain the legal rights to use any images, brand logos or slogans that are protected under the copywrite act within their product, if not done correctly this could result in taking longer for the product to be distributed or even fines.

Case study of how a product was affected by legal issues.

20th Century Fox sued Universal Studios (the studio behind Battlestar Galactica) for copyright infringement, claiming that it had stolen 34 distinct ideas from Star Wars. Among them was a character named Skyler, a tad too close to Skywalker, and the possibility of airing with the title “Star Worlds”.

IPSO - indipendente press standards organisation : regulatory of the uk's newspapers and magazines. Mail online was complained about to IPOS 15 times in 2021.

ASA - advertising standards authority : the ups regulatory of advertising. KFC add was complained to ASA for disrespecting vegetarians and chickens.

W3C - the World Wide Web consortium : developing standards and guidelines on the World Wide Web. complain about an inaccessible website. 

PEGI - pan European game information : provides age classifications for video games. complaint against NBA 2K20 as it depicts slot machines made to PEGI.
